If you have been injured on the job, you’ve probably heard about Michigan’s Workers’ Compensation statute, commonly referred to as Workers Comp.

What I want to talk to you about today is, if you’ve been injured on the job, Michigan’s Workers’ Compensation will only provide you benefits for your wage loss, and your medical bills. But will provide nothing for you for pain and suffering. I have had the pleasure of representing people who have been injured at work and have suffered significant injuries, assault type behavior or assault type injuries; rape, personal attacks and we have been able to get compensation for them, because we understand here what the law requires. The Michigan exclusive remedy provision of the Michigan workers compensation statute indicates that you are entitled to be compensated only for your wage loss and your medical bills, if the injuries are out of and during the course of your employment. However, a lot of attorneys aren’t really sure what that means.

For example, we represented a young lady who was sexually assaulted on the midnight shift, on the job. And we were able to bring a claim and obtain compensation for her even though the employer said the Michigan Workers’ Compensation Act was a complete bar for that claim. With our wealth of experience and understanding of the law we were able to point out to the judge that the Michigan Workers’ Compensation Act didn’t apply. In other words, we were fully aware of what the statute required. And we were able to represent a client by pointing out that even though they were injured at work, it didn’t arise out of the course of employment. And the statute required both an injury that arose out of and in the course of employment.
